Terms of Service

These Terms of Service ("Terms") govern your access to and use of Buzzz ("the Service"), the email and SMS platform operated at buzzzmail.co.za ("we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation.

1. The Service

Buzzz lets you send transactional and marketing email and SMS, manage contacts, and track delivery. We may change, suspend, or discontinue features at any time. We will give reasonable notice of material changes where practical.

2. Your account

You are responsible for activity under your account and for keeping your API keys and credentials confidential. You must provide accurate account information and promptly notify us of any unauthorised use.

3. Acceptable use

You agree that you will not use the Service to:

• send unsolicited bulk email or SMS (spam), or send to recipients who have not given you consent where consent is required by law;
• send to purchased, rented, or scraped contact lists;
• continue messaging a recipient who has unsubscribed, replied STOP, or otherwise opted out;
• impersonate another person or organisation, or send from a domain or number you are not authorised to use;
• distribute malware, phishing content, or content that is unlawful, deceptive, or infringes the rights of others;
• probe, disrupt, or circumvent the Service's security or usage limits.

You must comply with applicable messaging and privacy laws, including POPIA (South Africa), CAN-SPAM (United States), and GDPR (European Union) where they apply to your recipients. Marketing messages sent through the Service include an unsubscribe mechanism; you must not remove or obscure it.

4. Your content and your recipients' data

You retain ownership of the content you send and the contact data you upload. You grant us the licence needed to operate the Service — to store, process, and transmit that content on your behalf. As between you and us, you are the responsible party (controller) for your recipients' personal information; we process it on your instructions as described in our Privacy Policy.

5. Suspension and termination

We may suspend or terminate accounts that breach these Terms, generate excessive bounces or spam complaints, endanger the deliverability of the platform, or create legal risk. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including limitation of liability) survive.

6. Fees

Paid plans are billed as described at the time of purchase. Usage allowances (emails and SMS per month) reset each billing period and unused allowance does not roll over. We may change pricing with notice effective from your next billing period.

7. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. Email and SMS delivery ultimately depends on third-party networks and receiving providers we do not control, and we do not guarantee that any message will be delivered. To the maximum extent permitted by law, our total liability arising out of the Service is limited to the amount you paid us in the three months before the claim arose, and we are not liable for indirect, incidental, or consequential damages.

8. Changes to these Terms

We may update these Terms from time to time. If a change is material we will notify you by email or in the dashboard before it takes effect. Continued use of the Service after a change takes effect constitutes acceptance.
